Why Women Report Being in Worse Health than Men (LiveScience.com)

When asked to rate their own health, women, on average, consistently report being in worse health than men do, and a new study from researchers in Spain says this is because women have a higher rate of chronic diseases ? contradicting a previous theory that women's lower self-rated health is simply a reporting bias.

"In general practice, there has been this idea that women over-report health problems, or are more likely to say they are ill or pay attention to their symptoms than men," said first author of the study Davide Malmusi, of the Public Health Agency of Barcelona. "We wanted to test whether their differences in self-reported health could in fact be explained by the difference in the prevalence of chronic conditions."

The new findings were published Dec. 16 in the European Journal of Public Health.

Self-reporting health

Malmusi and colleagues across Spain gathered data from Spain's 2006 National Health Survey, which included data from face-to-face interviews with more than 29,000 people on their health. About half of the study participants were between the ages of 16 and 44; the other half was older.

The survey included the question, "Over the last 12 months, would you say your overall health has been very good, good, fair, poor, or very poor?" as well as a question on whether health problems had limited people's activities over the previous six months.

Of the women interviewed, 38.8 percent rated their health as poor or very poor, and 25.7 percent reported chronic limitation of activity. Of the men in the study, only 27 percent had poor self-rated health, and 19.3 percent reported chronic limitation of activity.

But when the researchers matched up the number of chronic conditions each person had with his or her health rating, the gender difference disappeared. Having a higher number of chronic conditions correlated with poorer self-rated health to the same degree in both genders.?

For men and women with the same conditions, or the same number of conditions, women were no more likely to claim poorer health.

"There's been a longstanding debate about whether women's self-reported health is a reporting bias or not," said sociologist Ellen Annandale of the University of Leicester in the United Kingdom, who was uninvolved in the new work. "Some researchers argue that women might over-report health problems, and men might under-report. This study supports wider research that women's poorer self-reported health reflects underlying chronic health problems."

The root of chronic health problems

What the new study doesn't answer, Annandale said, is why women have a higher rate of chronic health problems. The data did reveal that women's higher rate of chronic problems can be most strongly attributed to five chronic disorders: arthritis, mental disorders, neck pain, headaches and back pain. But further research will be needed to explain why.

Malmusi said it is likely a mix of biological and social factors.

"Gender influences that way that people are treated and diagnosed in health systems," Annandale said. "It influences the kind of health conditions that men and women suffer from, the way people relate to their own bodies, and what kind of access to health care they have."

Understanding gender differences in health can help scientists and doctors find ways to better treat patients, she said.

?"Women generally live longer than men, but in many countries that gap in life expectancy has been decreasing over time. One of the reasons for that is thought to be that men's health is improving, but women's is not."

Pass it on: ?The fact that women generally rank their health poorer than men do correlates to a higher rate of chronic health problems, not a higher likelihood to complain about their health or pay attention to symptoms.

Seven hurt as bomb hits madrassa in Nigeria (Reuters)

PORT HARCOURT/JOS (Reuters) ? Assailants threw a homemade bomb into a madrassa in southern Nigeria's Delta state, police said, wounding seven people and escalating tensions between Muslims and Christians after a spate of church bombings across the nation.

Six of the wounded were children younger than nine learning the Koran at the Islamic seminary, or madrassa.

In a separate incident, armed Fulani herdsmen shot dead three members of a family in the ethnically and religiously mixed Plateau state on Wednesday, witnesses and officials said.

The school attack on Tuesday night came two days after Christmas Day bombings of churches and other targets by Islamist militant group Boko Haram killed 32 people in a coordinated strike that seemed aimed at igniting sectarian strife.

"Some men driving in a Camry car threw a low-capacity explosive into a building where an Arabic class was taking place," police spokesman Charles Muka said.

"Children aged between four and nine were taking a lesson. Six children were injured and one adult," he said.

He said police suspected a local vigilante group.

Boko Haram, a sect which aims to impose Islamic sharia law across Nigeria, claimed responsibility for the December 25 attacks, the second Christmas in a row it has caused carnage.

The worst attack killed at least 27 people in the St Theresa Catholic church in Madalla, a town on the edge of the capital Abuja, and devastated surrounding buildings and cars as worshippers poured out of the church after Christmas mass.

The attacks risk reviving sectarian violence between the mostly Muslim north and Christian south, which has killed thousands of people in the past decade.

"DECLARATION OF WAR"

Speaking at a meeting with President Goodluck Jonathan on Wednesday, Ayo Oritsejafor, head of the Christian Association of Nigeria (CAN), an umbrella group for all denominations, said Christians had become victims of "Islamic Jihad."

"It is considered as a declaration of war on Christians and Nigeria," Oritsejafor said. "CAN has found the responses of ... Islamic bodies on this matter to be unacceptable and an abdication of their responsibilities."

"The Christian Community is fast losing confidence in government's ability to protect our rights."

Jonathan promised to do more to tackle the threat of Islamists and hinted at a reshuffle in his security services.

"We will restructure ... and make sure we get a team that will meet with the challenge we are facing today," he said. "I will plead with religious leaders, both Muslim and Christian leaders, to work together."

Nigerian Christians fear the Christmas Day bombings could lead to a religious war in Africa's most populous country.

There was no suggestion the killings in Plateau had any link to Sunday's church bombings, as the victims were Christians.

The state is a tinderbox of ethnic and religious rivalries over land and power between local people and migrants from other areas that often take the form of sectarian strife between the state's Christian and Muslim communities.

Women wept and wailed in anguish over the bodies of a husband and wife in their thirties and their baby child, all of which were riddled with bullet holes.

"When the Fulani herdsmen came around late in the night, I managed to escape through the window before they killed my son, daughter-in-law and grand-daughter with guns," said Mary Pam, the mother of Philip Francis, one of the victims.

U.S. approves Monsanto drought-tolerant GM corn (Reuters)

WASHINGTON (Reuters) ? Monsanto's genetically engineered, drought resistant corn is deregulated, the U.S. Agriculture Department said Thursday, clearing the variety for sale.

USDA approved the variety after reviewing environmental and risk assessments, public comments and research data from Monsanto.

Corn is the most widely grown U.S. crop and farmers grew 91.9 million acres of the feed grain this year, the second-largest area since World War Two.

In its 2009 petition for approval of its GM variety, Monsanto said 40 percent of crop losses in North America are due to sub-optimal moisture.

In a statement, Monsanto said it planned farm trials in the western U.S. Plains in 2012 to demonstrate the variety for growers and to generate data that will help guide Monsanto's commercial decisions.

"Our drought system is designed to help farmers mitigate the risk of yield loss when experiencing drought stress, primarily in areas of annual drought stress," said Hobart Beeghly, U.S. product management leader.

The drought-tolerant trait was part of a collaboration with the German chemical company BASF.

The major U.S. area for adoption of drought-tolerant corn would be the Plains, which produce one-quarter of the U.S. crop, Monsanto estimated, as well as similar dryland regions of Africa, Europe and Latin America.

USDA announced the variety, known as MON 87460, "is no longer considered a regulated article under our regulations governing the introduction of certain genetically engineered organisms."

Duane Ludwig gets Christmas present from UFC: Fastest KO record

Duane Ludwig gets Christmas present from UFC: Fastest KO record

UFC lightweight Duane Ludwig got the present he has been hoping for: an update in the UFC records to reflect that he has the fastest knockout in the promotion's history. Dana White tweeted over the Christmas weekend that Ludwig did have the fastest knockout, and that the UFC's record books will be changed to reflect that.

In 2006, Ludwig knocked out Jonathan Goulet off the bell, but the timekeeper from the Nevada Athletic Commission didn't stop the clock in time. Though replays of the fight showed that Ludwig had a four-second knockout, it was recorded at 11 seconds. That put him behind Todd Duffee, and more recently, Chan Sung Jung, who both have seven-second knockouts in the UFC.

Ludwig has lobbied the NAC to update their records, but it has not been changed. Now, whether they decide to change it or not, the UFC records will put Goulet squarely on top. He has a chance to better that record in January at UFC on FX against Josh Neer.

Celebs share big plans for pets in the new year | Bryan/College ...

?

Published Monday, December 26, 2011 12:00 AM

Retired game show host Bob Barker would like his pet, 8-year-old Mr. Rabbit, to spend more time in its litter box. And Mr. Rabbit's resolution for Barker? "To continue urging folks to have their pets spayed and neutered, including rabbits."

LOS ANGELES -- Tony La Russa would like his dog to spend more time in his lap. Bob Barker would like his rabbit to spend more time in its litter box. And Lea Michele would like her cat to spend less time in her cotton ball jar.

The Associated Press asked several celebrity pet owners about New Year's resolutions for their animals -- and resolutions their pets might have for them.

La Russa, the reigning World Series champion manager, would like it if his 12-year-old Chihuahua Twiggy would jump into his lap every time he sat down. "I'd like that affectionate reassurance every time, not just sometimes," he said.

And on behalf of Twiggy, La Russa would resolve to "be the person that Twiggy wants me to be and deserves for me to be."

Jazz singer Roberta Flack would resolve "not to have to beg Yogi, my shiba inu dog, to eat his breakfast or dinner so his food bowl would not be looking at us all day long! He likes to be begged to eat -- coerced -- given one bite from the bowl by hand."

And for her: "That I talk less and quietly. I have a seal point Siamese, Mimi-La, who likes to put her front paw on my face as if to say, 'Shhhhh."'

Flack didn't include resolutions for eight dogs, 12 cats, a llama, six horses, three donkeys, several Chinese chickens, a road runner, three flamingos and several geese she cares for after adopting them from petting zoos and other places.

CSI: Miami actress Eva La Rue would ask that "our bulldog Frank be less of a ham. He is so funny. He always needs to be right in the middle of the room where all the action is taking place. He constantly needs attention.

"If Frank made a New Year's resolution for me it would be that I would devote 100 percent of my time to him only. If my shnoodle, Bingo, made a resolution, it would be that he would get just some of the attention that Frank demands from us! LOL!"

It seemed fitting to ask some of the actors in the movie New Year's Eve for their resolutions.

Seven dogs -- Oscar, Romeo, Stella, Piper, Weaser, Flora and Tamber -- would like actress Katherine Heigl "to feed them consistently on time in the morning."

She wishes Oscar the hound would "not be so aggressive toward strangers. That would be good because I really don't want to get sued."

Academy Award winner Hilary Swank said of her two dogs: "They are so great. ... I wish they could do every interview with me and just sit right here and here. That would be my New Year's resolutions for my dogs -- that they're always with me."

Josh Duhamel would like his rescue dog Meatloaf "to really work on his coordination and work on getting a little more exercise because he's struggling right now. But he's still happy and he's not in pain. But it's really hard to get him to do anything. He's super lazy. He's like maybe the most unathletic animal you've ever seen."

Glee's Lea Michele says her cat Sheila needs a resolution.

"I wish that Sheila would stop going into my bathroom, taking out all my cotton balls out of the jars and spreading them all over. So her New Year's resolution would be to get over the cotton ball obsession."

Dog whisperer Cesar Millan would like his pit bull Junior to continue as "an ambassador for powerful breeds, reinforcing the message that it's not the breed, it's the human behind the animal." And Junior to Millan? "Accept yourself," he said.

Country singer Buddy Jewell wants his Akita Jack to "eat more pork chop bones!" And Jack, in turn, wants Jewell to "Grill more pork chops!"

Retired game show host Bob Barker's has an 8-year-old rabbit. Mr. Rabbit already follows Barker around the house "helping me in every way he can." If Barker could ask for more, it would be "to use his box every time, not just when it's convenient."

And Mr. Rabbit's resolution for Barker? What else? "To continue urging folks to have their pets spayed and neutered -- including rabbits."

China jails dissident 10 years for "subversive" essays (Reuters)

BEIJING (Reuters) ? A court in China sentenced on Monday a veteran dissident, Chen Xi, to 10 years in jail for subversion, his wife said, one of the heaviest sentences given for political charges since Nobel Prize winner Liu Xiaobo was jailed two years ago.

The court in Guiyang, southwest China, tried Chen, swiftly declared him guilty of "inciting subversion of state power," and said he deserved a tough sentence of a decade in prison, his wife, Zhang Qunxuan, told Reuters by telephone.

"The judge said this was a major crime that had a malign impact and he was a repeated offender," Zhang said by telephone.

"If the government wants democracy and progression, you need people who speak out their negative opinions," she said.

"To subvert you - can he do that? Does he have any army? Does he have a police force? Does he have courts? With a piece of paper and a pen, can he subvert you? Are you so fragile?"

Chen Xi, 57, was convicted over 36 essays critical of the ruling Communist Party that he published on overseas Chinese websites, said Zhang. The trial took about two and half hours, she added.

Chen said he would not appeal, because it would be futile, said Zhang.

An official at the Guiyang People's Intermediate Court telephoned by Reuters declined to give any information or to give contact details for the division of the court that tried Chen, who is also known as Chen Youcai.

"Inciting subversion" is a charge often used to punish dissidents, and China's party-run courts rarely find in favour of defendants in trials, especially for political charges.

Communist Party chiefs are preparing for a leadership handover late next year, when the party's long-standing focus on fending off political challenges is likely to intensify.

"Severe punishment is the Chinese government's clear choice of response to spreading protests at home and in many parts of the world: it is determined to 'kill the chicken in order to frighten the monkeys'," Renee Xia, the international director of the Chinese Human Rights Defenders, an advocacy group, said in emailed comments.

"Killing the chicken to frighten the monkeys," is a Chinese saying meaning singling out victims for harsh treatment in order to deter others.

"PAY-BACK"

The long sentence comes days after another dissident -- Chen Wei from Sichuan province in southwest China -- was jailed for nine years on similar charges of "inciting subversion." Chen is a common family name in China, and the two men are not related.

Liu Xiaobo, who was awarded the 2010 Nobel Peace Prize, was convicted on December 25, 2009, and jailed for 11 years for inciting subversion. In March this year, the dissident Liu Xianbin was also jailed for 10 years on subversion charges.

This month, a Beijing court sent one of China's best known rights lawyers, Gao Zhisheng, back to jail, though he appears never to have escaped secretive confinement in the first place.

Beijing chose the quiet Christmas period for these trials as it was trying to avoid international attention and diplomatic censure, said Nicholas Bequelin, a researcher on China for New York-based Human Rights Watch, an advocacy organization.

"It's not the sign of a confident government that feels it has a strong case against a particular individual," he said by telephone. "It's pay-back for decades of standing up to the government."

Police held hundreds of dissidents, rights activists and protest organizers in a crackdown on dissent this year, when the Communist Party sought to prevent the possibility of protests inspired by anti-authoritarian uprisings in the Arab world.

Chen Xi, however, was arrested only last month after being released from a week-long detention triggered by his campaigning for independent candidates seeking to win places in the party-controlled People's Congress assemblies, said Zhang.

Chen is a former soldier and factory worker who was jailed for three years for his support for 1989 pro-democracy protests that ended after troops crushed demonstrations, said his wife.

He was again jailed in 1996, but since his release in 2005 had been an organizer of a citizens' human rights forum in Guiyang.

China uses a "firewall" of Internet filters and blocks to prevent citizens from reading web sites abroad deemed to be politically unacceptable. But many activist use technology to break through obstructions and publish on uncensored websites.

The Chinese Foreign Ministry spokesman Hong Lei told a daily briefing that he did not know about Chen Xi's conviction. China is a "country of rule of law," added Hong.

BREVEMENTE ?

Cofidis, estrena identidad corporativa

Scott Weiland's 'Winter Wonderland' Frame By Frame

Foster the People and others help break down the Stone Temple Pilots frontman's Christmas video.
By Matt Elias

Scott Weiland in his "Winter Wonderland" video
Photo: Atco / Softdrive Records

With Christmas just around the corner, it's safe to assume you're enveloped in holiday tunes — whether inescapably at the mall or blaring from your laptop by choice. Beyond the old standards, there's Michael Bublé's chart-topping Christmas album and even Justin Bieber's first Christmas contribution, Under the Mistletoe, but you might not be aware that Stone Temple Pilots frontman Scott Weiland released his own holiday disc this year.

That's right, and while Weiland's The Most Wonderful Time of the Year dropped back in October, even some of his contemporaries were unaware of his Xmas effort. That gave us the perfect opportunity to share the album's first music video with the bands on the bill at KROQ's annual Almost Acoustic Christmas earlier this month. In true holiday spirit, the artists graciously took us through the kitschy retro-themed clip for "Winter Wonderland," frame by frame.

Initially, everyone was surprised by the video, in part due to Scott's never-before-heard classic croon, but also by his "Mad Men"-inspired, clean-cut new look.

"I like his scarf a lot," Marcus Mumford of Mumford & Sons said.

"He's very handsome," fellow bandmember Winston Marshall added.

While the reactions ran the gamut from "good" to "insane," there were other clues in the video, some believed, that this whole thing might be more of a wink and a nod than a serious musical venture.

"He kinda has a very weird eyebrow thing that I only noticed now for the first time," Grouplove's Ryan Rabin said.

"I can't tell if it's tongue-in-cheek or not," Mark Foster of Foster the People wondered. "You think it's tongue-in-cheek or you think he just lost his mind? 'Cause he definitely had a bout with [in]sanity for a while."

Of course, the sight of a '90s rock icon cozying up to the Yule log left some baffled, but Death Cab for Cutie had their own take on Weiland's "Wonderland."

"I mean, is he more Bing Crosby or is he more Danny Kaye?" DCFC's Chris Walla asked.

"He's got a lotta Bing, he's got a lot of ... I mean there's some Sinatra there too," DCFC bassist Nick Harmer said.

They both agreed that Weiland was fully committed to the act.

"And it's good! It's classic," Walla said.

"Thank you! I mean — yeah! Thanks for making that Scott, seriously," Harmer concluded.

What do you think of Weiland's version of "Winter Wonderland"? Tell us in the comments.

NBA reduces suspensions for Bynum, Villanueva

NEW YORK (AP) -- The NBA has reduced suspensions for the Lakers' Andrew Bynum and the Pistons' Charlie Villanueva by one game because of the shortened season.

The league on Friday trimmed one game off the five-game ban Bynum was given for knocking the Mavericks' J.J. Barea to the court in the second round of last season's playoffs. The center will now miss the first four games and be eligible to return Dec. 31 against Denver.

Villanueva was originally suspended five games for instigating an altercation with Cleveland's Ryan Hollins and attempting to escalate it by entering the Cavaliers' locker room. He served a game of it last season and will have to miss the first three of this season, and is also eligible to play to New Year's Eve against Indiana.

Gracenote launches ACR TV recognition, HABU mood-based music curation

It's that pop song again -- you know, the one that forces you to flip the radio to anything else. But still, you're dying to know what it's called, if only to avoid hearing it ever again. Boom Boom? Heartbeat? Shazam! Super Bass, by Nicki Minaj. If you haven't used Shazam, chances are you know someone that does, and often. Gracenote's new Automatic Content Recognition (ACR) technology takes that same concept and applies it to TV shows and movies, and it's coming soon to a smartphone or tablet near you. A yet-to-be-named app will let your device "listen" to whatever you're watching, identifying TV shows and movies based on dialogue or the soundtrack, then displaying a variety of info about whatever's on screen. Gracenote is also expanding its audio offerings, showing off both HABU and MoodGrid, which are mood-based music curation services for mobile devices and in-car systems, respectively. Software groups songs based on emotional themes, then plays them back depending on your selected mood. Happy? Sad? Intrigued? We'll need to wait until CES for the full scoop from Gracenote.

Penn St AD: 'Deliberate, measured' coach search

(AP) ? Penn State may still be without a replacement for fired coach Joe Paterno by the time the Nittany Lions play in the TicketCity Bowl on Jan. 2

The six-person search committee is taking a "very deliberate and measured approach to the process in order to identify the coach that best fits the requirements of the position," acting athletic director Dave Joyner said Thursday in a written statement.

School president Rodney Erickson and Joyner had both said they hoped to have a new coach before No. 24 Penn State's bowl game.

But Thursday, Joyner said a new coach would be introduced "at the appropriate time," and the statement offered no specific timeline.

Erickson was out of town Thursday for the holidays. Spokesman Bill Mahon said Joyner was providing Erickson with regular updates.

"I think they have both emphasized the most important element here is to get the right coach, not speed up the timing of the search," Mahon said. "There is no update on possible timing."

Longtime defensive coordinator Tom Bradley has been running the program on an interim basis since school trustees fired Paterno on Nov. 9 in the aftermath of child sex abuse charges against retired defensive coordinator Jerry Sandusky.

Paterno is not a target of an investigation into the Sandusky case by the state attorney general's office, though he was dismissed amid mounting criticism that school leaders should have done more to prevent alleged abuse. Sandusky, who has maintained his innocence, is awaiting trial.

Making a good hire, and soon, is generally seen as a critical step to secure the future of Penn State's storied football program. A couple of recruits have already revoked their verbal commitments to the school in the wake of the Sandusky scandal.

Erickson said earlier this month one of the top criteria in the coaching search is "how that person would fit into the value system of Penn State, which clearly has to be honesty, integrity and commitment to excellence in academics."

According to Joyner, the school "is continuing to talk with individuals that we're interested in and work through the interview process." He called it a "very important hire for Penn State."

Bradley and defensive line coach Larry Johnson are among those who have been interviewed.

Green Bay quarterbacks coach Tom Clements was scheduled to have a phone interview last week, USA Today has reported. At Packers practice Thursday, Clements declined comment on whether he was interested in the job and would not confirm if he had interviewed for it.

Nebraska's Bo Pelini also emerged this week on the seemingly endless rumored list of potential college-level prospects. Pelini after practice Tuesday called the reports irresponsible and untrue, and said he had not interviewed at Penn State.

As for the Nittany Lions, players have gone home for the holidays. They are scheduled to regroup Monday in Dallas to prepare for the bowl game against No. 20 Houston.

Frankincense in decline. Fewer gifts will grow on trees.

Frankincense production could fall by half in 15 years. New study of the fragrant resin finds that frankincense-producing trees are in jeopardy.

The biblical Christmas story of the three kings may need a rewriting, or at least a tweak to one of the gifts ? frankincense. Production of the fragrant resin, which is used in perfume and incense, could decline by half over the next 15 years, a new study finds.

Tapped from various species of the Boswellia tree that grow in the Horn of Africa and the Arabian Peninsula, frankincense?has been traded internationally for thousands of years. However, researchers warn that the trees are declining at a troubling rate.

Ecologists from the Netherlands and Ethiopia monitored Boswellia trees growing in 13 plots of about 65 acres (2 hectares) each located in northwest Ethiopia, near the source of the?Blue Nile river. The plots contained trees that were tapped for frankincense, as well as some that were left untapped. The researchers studied the survival, growth and seed production of more than 6,000 Boswellia trees over the course of two years.

Based on their finding, the researchers created demographic models to predict the fate of Boswellia populations. They estimate that the production of?frankincense?could drop to half over the next 15 years, and the number of Boswellia trees could decline by 90 percent in the next 50 years.

"Current management of Boswellia populations is clearly unsustainable," said study researcher Frans Bongers of Wageningen University in the Netherlands. "Our models show that within 50 years, populations of Boswellia will be decimated, and the declining populations mean frankincense production is doomed. This is a rather alarming message for the incense industry and conservation organizations."

The researchers cited a decline in both the tapped and untapped Boswellia tree populations they studied. This suggests that other factors are at the root of the problem, according to the ecologists.

"Frankincense extraction is unlikely to be the main cause of population decline, which is likely to be caused by burning, grazing and?attack by the longhorn beetle, which lays its eggs under the bark of the tree," Bongers said.

The study also showed that, along with high levels of mortality among adult trees, older trees were not being replaced by new trees because few Boswellia seedlings survived to become saplings.

"The number of fires and intensity of grazing in our study area has increased over recent decades as a result of a large increase in the number of cattle, and this could be why seedlings fail to grow into saplings," Bongers explained. "At the same time, a large proportion of trees we studied died after being attacked by the longhorn beetle."

The researchers recommend that management incentives be introduced to?preserve and protect?Boswellia populations and the future of frankincense production. The study is detailed online today (Dec. 20) in the Journal of Applied Ecology.

Mexico telecom regulator signs contracts to friends (Reuters)

MEXICO CITY (Reuters) ? The president of Mexico's phone and television regulator approved two contracts worth roughly $200,000 for businesses run by two friends, including one who works as a lobbyist for telecom companies.

The contracts were for public relations and legal work for Mexico's telecom regulator Cofetel and were signed by the agency's head, Mony de Swaan.

There is no evidence that de Swaan received a financial benefit from the contracts and he denies any wrongdoing.

But they are raising questions about his judgment as he tries to enforce fair play and more competition in industries dominated by the world's richest man, Carlos Slim, and companies representing a quarter of Mexico's stock exchange.

Mexico's public servants' law says officials should recuse themselves from matters in which they might have a personal interest, but it is vague on what constitutes a "personal interest".

"In light of these contracts, any decision by the regulator could be questioned," said Shannon O'Neil, a scholar at the Council on Foreign Relations in New York and an expert on Latin America who has previously written about Slim and the telecommunications industry.

De Swaan is adamant that he has always acted within the rules. "Mine is an irreproachable track record over 14 years as a public servant," he told Reuters.

In Mexico, any carelessness by regulators can have heavy consequences. Earlier this year, de Swaan's peer at Mexico's competition watchdog made offhand comments that raised charges of bias against Slim and he has since been blocked from voting on an appeal against a record $1 billion fine levied against one of Slim's companies.

De Swaan, appointed 18 months ago, has had success in cutting back phone fees but his decisions have been challenged in court by companies including Slim's fixed-line phone giant Telmex, while media mogul Ricardo Salinas' cellphone company Iusacell has also complained.

"Behind every legal attack, there's an interest that I've hurt," he said. "In every instance I will and I have defended myself ... Have no doubt of that."

He said he has never accepted gifts and once returned a bicycle given to him by an executive from Mexico's biggest television network, Televisa. A Televisa spokesman said there was no record of any gift to de Swaan.

De Swaan was appointed by President Felipe Calderon, who has repeatedly called for more competition in key industries, including telecommunications. The government declined to comment on Cofetel's decision to give the contracts to de Swaan's friends.

CLOSE FRIENDS

At issue are two contracts, which have been reviewed by Reuters, that de Swaan, a London School of Economics-trained technocrat, signed in August for work from a lobbying and public relations firm as well as legal counsel. An outline of the contracts is also available on Cofetel's website.

One went to outside counsel Pablo Hector Ojeda, who received roughly $90,000 for four weeks of work, and the other to Total Strategy, a PR firm founded by attorney Peter Bauer, which was paid about $120,000 for about four months' work.

Bauer and Ojeda are partners in a separate law firm and de Swaan calls them both close friends.

De Swaan has been using Bauer's weekend retreat at upmarket Valle de Bravo outside of Mexico City since mid-September, a few weeks after Total Strategy got its Cofetel contract, both men said.

De Swaan said he pays one-third of his monthly income to Bauer for the house. According to a declaration of income and assets dated May 2011, he earns 2.1 million pesos ($152,000) a year.

Both men declined to provide payment documents but Bauer said the arrangement is proper and defended their ties.

"(Ours is a) friendship based on mutual respect, trust and particularly on our common belief in honesty and ethical standards in our work and towards our country," Bauer said.

Ojeda declined to comment for the story.

Bauer also advises TV Azteca. As a lawyer, Bauer lobbied for the telephone industry early this year and tried to pitch for more work in the sector while Total Strategy had its Cofetel contract, according to Bauer and a memo reviewed by Reuters.

Three individuals in the industry said that de Swaan has in the last twelve months pushed them to hire Bauer. De Swaan denied that, saying he only responded to a request from business-to-business phone company Alestra, which was looking for an adviser in Supreme Court matters.

"There are times when regulated companies come to me and ask 'Do you know someone who could be good for this work?'" he said.

Bauer and de Swaan said they believe Cofetel's relationship with Total Strategy and that company's clients was proper since their interests were aligned. De Swaan says there have been no conflicts of interest because neither Bauer nor Ojeda have brought any official business to Cofetel's full board.

Barracuda babies: Novel study sheds light on early life of prolific predator

Friday, December 16, 2011

For anglers and boaters who regularly travel the coasts of Florida the great barracuda (Sphyraena barracuda) is a common sight. Surprisingly, however, very little is known about the early life stage of this ecologically and socio-economically important coastal fish.

In the journal Marine Biology, lead author Dr. Evan D'Alessandro and University of Miami Rosenstiel School of Marine & Atmospheric Science colleagues Drs. Su Sponaugle, Joel Llopiz and Robert Cowen shed light on the larval stage of this ocean predator, as well as several other closely related species.

"Due in large part to the expense and difficulty of collecting fish larvae from the open ocean, the larval ecology of barracuda were a mystery until now," said D'Alessandro. "A research study led by Dr. Robert Cowen, which sampled the Straits of Florida regularly for two years, provided a unique opportunity to catch a glimpse of the larval life of many fishes."

The study samples included great barracuda (92.8%) and their relatives Sphyraena borealis and Sphyraena picudilla (6.6%), commonly known as sennets.

In their larval stage, which generally lasts several weeks, barracuda and sennets remain in the upper 25 m of the ocean and live on a similar diet. They start out consuming copepods, or small crustaceans, but make an early switch to a diet of fish larvae, much like several larval billfishes and tunas.

"Barracuda are an important element in the marine food chain; they are voracious predators of other fishes as juveniles and adults on reefs and other nearshore habitats. Now we know this holds true for their larval stage before they reach an inch in length, as well," said D'Alessandro. "This novel study unlocks important aspects of the barracuda's life cycle. It also identifies an important size advantage within the larval stage (bigger larvae are more likely to survive) and provides insight that resource managers can use to better manage this species."

DumpTruck Is A File Storage System With Roots In Usenet

Screen Shot 2011-12-15 at 4.15.49 PMIf you're familiar with Usenet, you'll be well aware that the newsreading platform is, well, not longer about newsreading. In fact, most Usenet providers are, by necessity, experienced data storage providers. That being said, GoldenFrog has just announced DumpTruck, a WebDAV file-sharing resource that, in the wrong hands, could end up a SOPA target. The service lets you store data in the cloud. It's free for holders of "Diamond" Giganews Usenet accounts and costs $99 for a full terabyte of monthly storage. DumpTruck promises anonymous, worry-free storage with, interestingly, no data reduplication. This means DumpTruck won't compare your files with other files and save only one copy. Your folder is your folder, no matter how full.

France's Jacques Chirac convicted of corruption (AP)

PARIS ? As French president, Jacques Chirac was called all sorts of names, not the least for his vociferous opposition to the U.S.-led war in Iraq. Now, he has a moniker that will stick: Convicted criminal.

The avuncular 79-year-old on Thursday became France's first former leader to be convicted since Marshal Philippe Petain, who headed the Nazi collaborationist regime during World War II, in 1945. Chirac will not go to prison, but received a two-year suspended sentence for corruption linked to his 18-year term as the mayor of Paris.

In a statement hours after the decision, Chirac said though he "categorically contest(ed)" the verdict, he would not appeal.

Despite the "pain and the profound sadness this verdict has inflicted," the statement said, "I sadly no longer have the necessary strength to lead before new judges the combat for the truth."

He said that as mayor, "it is up to me and me alone to take responsibility," but stressed that "above all, I affirm with honor: I cannot be blamed for anything."

"I leave (judgment) to my compatriots, who know who I am: an honest man who never had any other desire or motivation than the unity of the French people, the greatness of France, and action in favor of peace."

The verdict was an uncomfortable coda to Chirac's four-decade career as a fixture of French politics, and could aid efforts by critics to rid the political system of its cushy cronyism. It also tarnishes the lofty image that French presidents often enjoy at home just as the country gears up for another presidential race.

Chirac was found guilty in two related cases involving 19 totally or partially fake jobs created for his benefit at the RPR party, which he led as Paris mayor from 1977 to 1995. He was convicted of embezzling public funds, abuse of trust, and illegal conflict of interest.

Critics of the conservative Chirac ? many on the political left ? hailed the decision as measured and courageous, saying the court showed how political elites and average citizens were equal under the law. Anti-corruption crusaders, long frustrated by dirty dealings in the French political machine, rejoiced.

"I see it as a historic and very important decision for the future of French democracy," said Jerome Karsenti, a lawyer for the anti-corruption group Anticor, which had argued against Chirac as a civil party to the case.

"This is a strong message from the court ? a message to all politicians of responsibility. It's also proof of a mature and transparent democracy that is today able to make a distinction and try a former president," Karsenti added.

Allies, however, expressed personal sadness for Chirac, praising him as a defender of French values on the world stage who was now embarrassed by what some characterized as a scandal of little consequence.

"This is a decision that I don't believe will alter the personal relationship between the French people and Jacques Chirac," said Prime Minister Francois Fillon, a fellow conservative.

"This conviction is severe ? it's both criminal and moral," said Francois Hollande, the Socialist Party presidential candidate, who recently appeared in public with Chirac. "It strikes at the man, so I have a thought for him."

Because Chirac has suffered from ill health and memory lapses recently, he was spared from appearing in court for a trial sought for years by investigating judges. The trial, which started in March, only became possible after he left office and lost his presidential immunity in 2007.

The three-judge panel juggled an array of considerations as they handed down their 120-page ruling: Chirac's age and fading memory; the state prosecutor's call for the case to be thrown out for a lack of evidence; a recent reimbursement deal between Chirac, his allies and Paris City Hall.

In the end, the court faulted Chirac for criminal exploitation of political tools ? even if he never benefited financially ? that cemented his march to higher office.

"His guilt results from perennial and repeated practices attributed to him, and whose development was greatly favored by a perfect understanding of the wheels of the city machinery," the court said in its ruling.

The court said it took into account his age, health and status as a former head of state when determining the light sentence ? Chirac could have been jailed for up to 10 years and fined euro150,000 ($210,000).

The other nine defendants on trial included members of France's political elite. Two were acquitted and seven convicted, including former French leader Charles de Gaulle's grandson, the brother of the Constitutional Court president, and former Chirac aides.

Chirac has repeatedly denied wrongdoing.

In a brief statement, President Nicolas Sarkozy said "it is not his place to comment" on the verdict but commented anyway.

"These circumstances mustn't make us forget Jacques Chirac's constant commitment to serving France, which won and continues to win him the affection of the French," said Sarkozy, whose conservative UMP party is the successor to Chirac's RPR party.

In another recent scandal, two longtime Sarkozy allies have been targeted in a case of suspected kickbacks in a 1990s French defense deal with Pakistan. Sarkozy served as budget minister at the time, but his office and allies insist he was not involved.

Chirac's adopted daughter fought back tears after the ruling.

"The justice system has been very severe, but this is a fair and independent justice system. For the family, it's a great pain we have to accept," said Anh Dao Traxel, her voice cracking with emotion outside the courtroom.

A career politician, Chirac was a debonair master of the workings of public office. He modeled himself after de Gaulle, and was nicknamed "Le Bulldozer" early in his career for his determination and ambition.

France's last leader with memories of World War II, Chirac was the first to acknowledge the nation's responsibility for the deportation of Jews during the Holocaust. But he struggled to achieve reforms to the regulated economy and failed to defuse tensions between police and minority youth that exploded into riots in 2005.

Now focusing on charitable work now, he is one of France's most popular public figures.

Chirac made his reputation internationally for refusing to join U.S. President George W. Bush's drive to the war that toppled Saddam Hussein as leader of Iraq in 2003 ? fomenting some anti-French feeling in the United States.

A Las Vegas radio station once used an armored vehicle to crush photographs of Chirac, photocopies of the French flag, a Paris travel guide, bottles of wine and French bread. French fries in Congress were renamed "freedom fries," and some critics called the French "cheese-eating surrender monkeys" ? a barb pulled from "The Simpsons" TV cartoon show.

PSA: Verizon's Galaxy Nexus getting Android 4.0.2 update today

Big Red confirmed as much in yesterday's under-the-radar announcement, but we're now receiving reports that some users are being prompted to update their LTE-enabled Galaxy Nexus to Android 4.0.2. It's taking around two to three hours after activation for the update to hit, with ICL53F bringing an optimized mobile hotspot when used with VPN, a few notification fixes and visual improvements to the lock screen. It'll also now automatically reconnect to known WiFi access points, and those wonky email attachment issues that a few folks were having are gone. Oddly, DivX support has actually been yanked, though the company promises to support it "in a future upgrade" -- we're guessing the support that was baked in simply had too many issues to go to market with. It weighs in at 10.7MB; let us know how your installation goes in comments below.
